What is a Geographical Indication (GI)?

A Geographical Indication (GI) is a sign used on products that originate from a specific geographical region and possess qualities, reputation, or characteristics that are essentially linked to that location. These products usually derive their uniqueness from local natural conditions, traditional knowledge, or specialized skills of producers in that region. In India, geographical indications are protected under the Geographical Indications of Goods (Registration and Protection) Act, 1999.

What types of products can be registered as Geographical Indications?

A wide range of goods can be registered as GIs, particularly those whose quality or reputation is connected to a particular place.

These generally include:

  • Agricultural products
  • Natural products
  • Handicrafts and handloom goods
  • Manufactured goods with regional characteristics

Well-known examples include Darjeeling Tea, Kanchipuram Silk Saree, and Banarasi Saree.

Who can apply for a Geographical Indication registration?

A GI application is generally filed by an association of persons, producers, organizations, or statutory bodies representing the interests of producers of the goods. Individual producers normally do not apply directly for GI registration. Instead, they may later register themselves as authorized users of the GI once it is registered.

What rights does a Geographical Indication registration provide?

Once a GI is registered, it grants the registered proprietor and authorized users the exclusive right to use the GI for the goods originating from that specific region. The registration also allows the rights holders to take legal action against unauthorized use or misuse of the geographical indication.

How long is a Geographical Indication registration valid?

A GI registration is valid for 10 years from the date of registration and can be renewed for further periods of 10 years by paying the prescribed renewal fee.

What is an authorized user of a GI?

An authorized user is a producer who is legally permitted to use the registered geographical indication for the goods. Producers from the relevant region may apply to be recorded as authorized users so that they can lawfully market their goods under the registered GI name.

What happens if a Geographical Indication is misused?

Unauthorized use of a registered geographical indication is considered an infringement. The registered proprietor or authorized users may initiate legal proceedings to stop the misuse and protect the reputation of the product. Courts may grant remedies such as injunctions, damages, or other appropriate relief to prevent misuse of the GI.
